US Service Members Are Spreading The Word About The Faulty And Defective 3M Combat Army Earplug

Each time news hits the media of another service member that has filed a lawsuit against 3M other injured veterans are encouraged to follow suit

Thursday, September 12, 2019 - Each US Army service member that files a lawsuit against 3M Inc., claiming that the faulty and defective 3M Combat Army Earplugs caused their hearing injuries alerts other members of the armed forces that they may be eligible to file a claim. I try to write about each case as they arise to spread the word to soldiers that have been deceived and left in the dark about the true cause of their hearing impairment. The 3M Combat Army Earplug failed by their faulty design to adapt to the various sizes of our soldier's ear canal and allowed loud, deafening noise to penetrate causing hearing loss. The earplugs design was insufficient to allow them to be inserted effectively in the heat of combat. A worker for 3M turned whistleblower and, along with the Department of Justice (DOJ) sued 3M for knowingly defrauding the government about the effectiveness of the product that was intended to protect US soldiers. Thousands of US service members have lost their hearing to one degree or another as a direct consequence of 3M's negligence and it is unknown how many soldiers lost their lives in battle when the hearing protection they relied upon failed. The failure of the 3M Combat Army Earplug has led to hearing impairment becoming the number one reason servicemen are collecting disability income from the gulf and Afghanistan wars costing the US taxpayer billions of dollars with no end in sight.

In late August 2019, disabled US Navy veteran Stevan Mayo filed a lawsuit against 3m for the hearing disability he suffered when relying on the 3M Combat Army Earplugs during his four tours of duty in Afghanistan and Iraq. Mayo claims "3M knowingly distributed defective earplugs to the U.S. military and that the faulty equipment failed to protect his ears from developing tinnitus, and the earplugs had a dangerous design defect that caused them to imperceptibly loosen in the wearer's ear." Mayo claims that 3M Combat Army Earplug "utterly failed to provide even the most basic level of hearing protection," according to the Casper Star-Tribune.

Mayo's lawsuit is one of the thousands that have been filed by servicemembers that used the faulty and defective hearing protection device. One attorney in New York has filed on behalf of 500 servicemembers and one in Texas is representing 100 disabled service members. According to The Tribune, over three-quarters of one million 3M Combat Army Earplugs were sold to the military beginning in 2006 generating close to $10 million in revenue to 3M.

Hearing loss is a terrible injury, on par with blindness or the loss of limb, in that it prevents its victims from ever again being able to engage in a large number of occupations or pursue professions. Most hearing-impaired servicemembers face a lifetime of being forced to live on the meager income of their military disability income and pension that provides for no more than a basic subsistence income.
