Claims for disability income from hearing injuries were backed up when the Department of Justice fined and received $9 million from 3M Inc. for their negligence in failing to warn the military that the protective earplugs they were issued often did not fit and were to blame for their ear injuries. It is reported that the $9 million was paid to the US government to reimburse taxpayers that now have to foot the bill for service disability income and did not actually make its way to injured servicemembers. Today, thousands of military personnel are forming groups centered around the military bases to which they were assigned to file suit against 3M, maker of the defective army earplugs. 3M was able to hide the defect by burying the earplug order deep within a multi-billion dollar defense contract the company was awarded, however, the company's wrongdoing did not escape a 3M whistleblower who exposed the company's fraud. According to the Baltimore Sun, "The Justice Department suit alleges the defect allowed them to come loose in a wearer's ear, allowing damaging noise through." Army personnel are required to fire heavy artillery, tank cannons, and machine guns every day. Army personnel was led to believe that the 3M Combat Arms earplugs would protect them from hearing damage on the firing range and on the battlefield. According to Consumer Reports, the symptoms tinnitus sufferers report include "trouble sleeping, difficulty hearing and concentrating, social isolation, depression and anxiety, and stress." Some military personnel with tinnitus are being driven insane by the constant buzzing or ringing sound that makes sleeping impossible. Drinking alcohol is known to increase the blood flow to the inner ear and make tinnitus symptoms even worse. Many tinnitus sufferers are forced to sleep with the tv or a fan on providing background noise to distract from the ringing.

Battlefield earplugs are not the simple plug sold in retail stores and need to serve to block battlefield noise but must allow the soldier to communicate with each other. Hearing protection technology is advancing rapidly. According to Engadget.com, "The (US Army) has been gradually rolling out a smart earplug, TCAPS (Tactical Communication and Protective System), that adapts to the audio realities of war. The smartphone-linked device softens louder noises, but amplifies quieter ones; if your squad leader needs to issue a command, you'll hear it over the din of battle."
