Saturday, November 14, 2020 - Hearing loss from tinnitus is not a simple disability with a one-size-fits-all cure. Tinnitus sufferers experience "too much" noise in the form of the constant ringing in the ears that make other sounds such as voices indistinguishable. Most tinnitus sufferers are unable to sleep without a fan or television on all night to compete with the sound that is in their head. Thousands of soldiers returning home from overseas combat with tinnitus have filed lawsuits against 3M, the manufacturer of the 3M Dual-Sided Combat Army Earplug, for selling the military an allegedly faulty and deceptive hearing protection device.

Hundreds of thousands of soldiers returning from overseas wars in Iraq and Afghanistan have experienced hearing damage from tinnitus so severe that they are now unable to assimilate back into society, hold down a job, or have family and spousal relations. Lawsuits filed by soldiers with hearing damage seek to hold 3M, the maker of the allegedly faulty Army Earplugs liable for lying about the performance of the earplugs, for failing to redesign the earplugs to the military's standards, and for covering up what the company knew about the earplugs defects, among other claims. In 2016 3M settled a whistle-blower and Department of Justice lawsuit for $9.1 million after Aearo Inc., executives came forward with their knowledge of these problems.

Legal experts estimate that should soldiers prevail in their Army Earplug lawsuits, 3M could pay billions of dollars in compensatory and punitive damages, and the flood gates would be open for more government claims. The Veteran's Administration (VA) tells us that over 800,000 soldiers have listed hearing damage as the reason for claiming disability income payments, costing US taxpayers billions of dollars every year. 3M, the manufacturer of the allegedly faulty Dual-Sided Combat Earplug, is the defendant in the largest mass tort lawsuit since asbestos was shown to cause cancer in the 1970s. Law.com estimates that more than 200,000 soldiers have filed suit and Bloomberg Law thinks that many more will join the multidistrict litigation in the months to come. According to Bloomberg Law, "3M Combat Arms Earplug products liability multidistrict litigation (MDL) now has the most actions of any MDL ever. And, as plaintiffs claim these earplugs were a standard military issue for more than a decade, this may only be the tip of the iceberg. According to reports from the U.S. Judicial Panel on Multidistrict Legislation, including the most recent Oct. 15 MDL Statistics Report, "3M Combat Arms Earplug Liability Litigation MDL has amassed 203,722 total actions since its 2018 inception, surpassing Asbestos Products Liability Litigation, which has been pending since 1991." Bloomberg Law sites the U.S. Judicial Panel on Multidistrict Litigation Pending Dockets as of October 15, 2020, to list other large MDLs in order of the number of plaintiffs as "3M Combat Army Earplugs, followed by Asbestos, Ethicon Pelvic Repair Systems, Xarelto, and Boston Scientific Pelvic Repair Systems. " The first trial is scheduled for April 5, 2021.
